General Terms and Conditions
1. General Information
1.1. These General Terms and Conditions (hereinafter referred to as the Terms) establish the terms and conditions for the provision of services, ordering, payment, cancellation, replacement and refund when services are ordered on the website www.dearmemory.lt (hereinafter referred to as the Website).
1.2. The Website Manager and Service Provider is Edita Milaševičiūtė, who carries out individual activities under an individual activity certificate (hereinafter referred to as the Service Provider).
1.3. The Service Provider provides the following services:
– tour guidance/guide services,
– photography activities (except for photojournalism activities),
– bookbinding/finishing services (binding and finishing of photo books/albums).
1.4. By ordering the services, the client (hereinafter referred to as the Client) confirms that he/she has read these Terms and Conditions and the Privacy Policy.
2. Ordering and payment for services
2.1. Services are ordered online via the Website or by contacting by e-mail/phone.
2.2. Prices for services are indicated on the Website or agreed individually with the Client.
2.3. Services are considered ordered from the moment the Service Provider confirms the order by e-mail or in another agreed manner.
2.4. When booking a service, the client may be asked to pay the full amount or part of it as an advance payment (deposit) confirming the order.
2.5. The advance payment is not considered final income until the moment the service is provided, but is viewed as the client's obligation to purchase the service.
2.6. If the client cancels the reservation for a guided tour no later than 36 hours before the start of the service, the advance payment is refunded within 7 business days. If the cancellation is made later or the client fails to arrive, the advance payment will not be refunded.
3. Cancellation and change of excursions and other services
3.1. The Client has the right to cancel a reserved excursion or other service no later than 36 hours before the start of the service. The start of the service shall mean: in excursion service, that is the start of the excursion; in photobook, that is the time when written or oral text or photos are transferred to the Service provider, and so the editing work starts.
3.2. In such a case, the amount paid by the Client shall be returned to the bank account specified by him within 7 (seven) business days from the confirmation of the cancellation.
3.3. If the service is cancelled later than 36 hours, the amount paid shall not be refunded.
3.4. The Client has the right to change the date or time free of charge, if he notifies about it no later than 18 hours before the provision of the service, and if the new time is free.
3.5. If the service cannot be provided due to unforeseen circumstances (illness, emergency, adverse weather conditions, etc.), the Service Provider undertakes to offer a new time or refund the money paid to the Client.
4. Photography and photobook services
4.1. The photos taken during the photography session are the creative product of the Service Provider; therefore, their copyright belongs to the Service Provider, unless otherwise agreed in writing.
4.2. The text and visual content of the photobook (photo album) are coordinated with the Client before printing.
4.3. After the content has been coordinated and approved by the Client, claims regarding the content (text, selection or arrangement of photos) are not accepted.
4.4. If the printing or production is of poor quality due to an error by the printing house or the Service Provider, the Service Provider undertakes to correct the error or create a new copy at its own expense.
4.5. If damage occurs during transportation, the Client must contact the courier service that delivered the shipment and submit claims for compensation for damages.
4.6. The photo book production term is customised individually and depends on the complexity, printing house occupancy, and delivery conditions.
5. Liability
5.1. The Service Provider is liable only for direct losses incurred through its fault, when it is proven that the service was not provided or was provided improperly.
5.2. The Service Provider is not liable for indirect losses or lost profits incurred by the Client.
5.3. The Client is responsible for providing correct data and making timely payment.
5.4. The Client must behave respectfully and safely during the excursions; the Service Provider has the right to terminate the service if the Client's behaviour poses a danger to others or disrupts the provision of the service.
6. Processing of personal data
6.1. The Client's personal data is processed in accordance with the Privacy Policy provided on the Website.
6.2. By ordering services, the Client agrees to the processing of his/her personal data for the purposes of providing the service.
6.3. The Client has the right to withdraw consent to the use of his/her image for advertising or publicity purposes at any time.
7. Final provisions
7.1. These Rules shall enter into force on the date of their publication on the Website.
7.2. The Service Provider reserves the right to amend the Rules by updating their wording on the Website.
7.3. Disputes between the Client and the Service Provider shall be resolved through negotiations. If an agreement cannot be reached, disputes shall be considered in accordance with the procedure established by the laws of the Republic of Lithuania.
